This Licence is a binding legal agreement between you and First Aid Fast App Pty Ltd ACN 605 351 960 (First Aid Fast)

By downloading, installing, accessing or using the accompanying software (the Application) you will be bound by the terms of this Licence.

If you do not agree to the terms of this Licence:

• First Aid Fast does not grant to you any right to use or access the Application,
• You must not download or install or access or use or copy the Application

APPLICATION ACCESS AND USE LICENCE

The Application is licensed to you, not sold.

Except for the limited licence granted in this Licence, First Aid App and its licensors retain all right, title and interest in the Application, including, without limitation, copyrights, patents, trade marks and trade secrets.

1. 1.   GRANT OF LICENCE

First Aid Fast grants you a revocable, non exclusive, non transferable licence to use the object code version of the Application on your portable hand held device.

2. 2.   LIMITATION ON LICENCE

The licence granted to you by this Licence is restricted:

• Limitations on Copying and Distribution

  You must not copy or distribute the Application except to the extent that copying is necessary to use the Application as contemplated by this Licence

• Limitation on Reverse Engineering and Modification

  You must not reverse engineer, decomplile, modify or create works derivative of the Application

• Sublicence and Third Party Use

  You must not assign, sublicence, rent, timeshare, loan, lease or otherwise transfer the Application, or directly or indirectly permit any third party to use or copy the Application

• Proprietary Notices

  You must not remove any proprietary notice, such as copyright and trademark notices, from the Application

• Use in Accordance with Documentation

  All use of the Application must be in accordance with its then current documentation

• Compliance with Law

  You are responsible for ensuring that your use complies with all laws

1. 3.   TERMINATION

This Licence will terminate if:

• You breach any of its terms, or
• Immediately on notice to that effect to you by First Aid Fast.

1. 4.   DISCLAIMER

To the maximum extent permitted by law, First Aid Fast and its licensors disclaim all warranties with respect to the Application including, without limitation:

• Non infringement of third party intellectual property
• Title
• Merchantability
• Quiet enjoyment
• Quality of information, and
• Fitness for purpose
• First Aid Fast does not warrant that:
• The Application will meet your requirements
• The operation of the Application will be error free
• The operation of the Application will be secure, uninterrupted or operate at all, or
• Defects in the Application will be corrected

First Aid Fast does not provide medical advice or diagnosis.

Use of the Application does not create a doctor-patient relationship. You are solely responsible for your decision to seek and obtain medical treatment

This Application was designed for educational purposes and not rendering medical advice. You covenant that you will not use the Application for obtaining medical advice.

1. 5.   LIMITATION OF LIABILITY

To the maximum extent permitted by law, in no event will First Aid Fast or its licensors be liable to you or any third party for any direct, special, incidental, consequential, punitive or indirect damages (whether in contract or tort, including, without limitation, negligence or otherwise) which include without limitation damage for personal injury, lost profits, lost data and business interruption, arising out of the use or inability to use the Application, whether or not First Aid Fast has been advised of the possibility of such damages

In any event, the total liability of First Aid Fast and its licensors under this Licence or resulting form this Licence is limited to the amount paid by you for the Application

1. 6.   INDEMNITY

You indemnify and keep First Aid Fast and it licensors indemnified in respect of all costs and expenses including legal costs calculated on a lawyer own client basis arising from a breach by you of any part of this Licence.

1. 7.   GENERAL

This Licence is governed by and to be construed in accordance with the laws in force in Victoria, Australia.

Any action or proceeding brought under or in respect of the Licence or the Application must be brought in the Courts of Victoria, Australia.

This Licence constitutes the entire understanding between you and First Aid First with respect to the Application and the subject matter of the Licence.

The rights and obligations of the parties under this Licence do not merge on completion of any transaction or matter contemplated by this Licence and are additional to any right, power or remedy which it may have under general law or otherwise.

A provision or part of a provision of this Licence that is void, illegal or unenforceable may be severed from this Licence and the remaining provisions or parts of the provisions of this Licence continue in force.
